As per Section-39 of the RERA, a party to the complaint, which has already been decided by the Authority, may file an application for rectification of any mistake apparent from the record. The scope of this section is limited to rectification of a typographical mistake only and cannot be used for such modification which can amount to an amendment in the substantive part of the order. The following conditions must be met for filing an application under section 39:-

• 1. No application for rectification can be entertained after 2 years from the date of order, or the date of uploading of the order in case the same is different from the date of the order.
• 2. No application for rectification can be filed if an appeal has been preferred against such an order.
